These Terms & Conditions ("Terms") are a binding agreement between you and Briox Technologies LLC ("BRIOX," "we," "us"). By creating an account or using the BRIOX app or services (the "Platform"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.
BRIOX is a technology platform that connects customers who want vehicle detailing ("Customers") with independent detailing professionals ("Detailers"). BRIOX does not perform detailing services, does not employ Detailers, and is not a party to the service agreement between a Customer and a Detailer. Detailers are independent contractors, solely responsible for the services they provide. BRIOX does not guarantee the quality, timing, safety, legality, or outcome of any service.
You must be at least 18 and able to form a binding contract. You are responsible for your account and for keeping your credentials secure, and for all activity under your account. You agree to provide accurate information and to keep it current. Detailers must additionally maintain all licenses, permits, and insurance required to operate lawfully.
Vehicle detailing involves inherent risks, including risks to vehicles, property, and persons, and the use of water, chemicals, and equipment. To the fullest extent permitted by law, you knowingly and voluntarily assume all such risks arising from services arranged through the Platform, including risks related to pre-existing vehicle conditions, wear, or damage not caused by the Detailer.
Water run-off & drainage. Mobile detailing uses water that becomes run-off at the service location you choose. You are responsible for confirming that on-site washing is permitted at that location and that it complies with all applicable local drainage, storm-water, and environmental ordinances, as well as any HOA, apartment, or property rules. To the fullest extent permitted by law, you assume all risk relating to water run-off at the location you select, and neither BRIOX nor the Detailer is liable for run-off or its consequences there.
The Platform and all services arranged through it are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
To the fullest extent permitted by law, BRIOX and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or vehicle/property damage, arising out of or relating to the Platform or any service arranged through it, whether based in contract, tort, or otherwise, even if advised of the possibility of such damages. To the fullest extent permitted by law, BRIOX's total aggregate liability for any claim relating to the Platform will not exceed the greater of (a) the total fees BRIOX earned from your transaction(s) giving rise to the claim in the 12 months before the event, or (b) US$100.
Some jurisdictions do not allow certain limitations or the exclusion of certain damages (including for gross negligence, willful misconduct, personal injury, or non-waivable consumer rights); in those cases the above applies to the maximum extent permitted, and nothing in these Terms limits liability that cannot be limited by law.
You agree to indemnify and hold BRIOX harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Platform, your breach of these Terms, or, if you are a Detailer, the services you provide.
Pricing. Detailers set their own prices. When you book a specific detailer (or through their booking link), that detailer's price is shown and locked before you book. When you book “first available,” the Platform shows an estimate based on what detailers serving your area charge, and places a temporary authorization on your card for the top of that estimate. When a detailer accepts, you are shown that detailer's exact price and must confirm it before the service proceeds; if you decline, or do not respond within the time shown in-app, the request is offered to other detailers at no charge to you. If the confirmed price is higher than the authorization, the authorization is replaced with one for the confirmed amount. BRIOX charges a platform service fee on each booking in addition to the wash price(s), and may charge disclosed add-on fees. Tips are optional. Your card is charged only after the service is completed and you approve (or the approval window lapses).
Cancellations. You may cancel free of charge before a detailer accepts your request, and for a short grace period (currently two minutes) after a detailer accepts. If you cancel after that grace period once a detailer is en route or on-site, a flat late-cancellation fee (currently US$10) applies and is paid to the detailer for their travel and time. Choosing a different detailer instead of cancelling is always free. The exact, current amounts are shown in-app at the time of booking and cancellation.
Excessive filth & biohazard. Standard services exclude biohazardous materials. If, on arrival, the detailer determines the vehicle contains biohazardous materials or is excessively dirty beyond the booked scope, BRIOX may decline service and retain a service-call fee (currently 25% of the booking price) to cover travel, fuel, scheduling, and related costs, with the remainder refunded.
Detailers are responsible for carrying and maintaining their own insurance adequate for their services. BRIOX's verification of a Detailer's documents does not constitute a guarantee or assumption of responsibility for the Detailer's conduct or coverage.
If you have an issue with a service, report it through the app. BRIOX may, at its discretion, help mediate between the Customer and Detailer, but is not obligated to resolve disputes and is not responsible for the acts or omissions of either party.
Governing law. These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. To the extent a dispute is not otherwise resolved, you and BRIOX agree to the exclusive jurisdiction and venue of the state and federal courts located in Texas.
You grant BRIOX a limited license to use content you submit (such as before/after photos) to operate the Platform, verify work, and resolve disputes. You represent you have the rights to the content you submit.
You may delete your account at any time from your profile; BRIOX may suspend or terminate accounts that violate these Terms. Certain records may be retained as required for legal, accounting, or dispute-resolution purposes.
We may update these Terms. Material changes will be posted here with a new version and effective date, and continued use after changes take effect constitutes acceptance.
